Hardcore Singer Alleges Police Brutality Over 2005 Incident
November 3, 2007According to the Sun Post, the Manteca, California police department has been sued by two men — including a singer with the Northern California hardcore band THE SLUMLORD CREW — who claim they were beaten up by police officers responding to a rowdy concert at a Manteca bar two years ago.
THE SLUMLORD CREW's David Martinez and a concert-goer, Jeremy Brouwer, allege in a lawsuit filed Sept. 17 at a federal courthouse in Fresno that several Manteca police officers beat them and used excessive force.
The lawsuit also accuses the city of Manteca, the police department and the police chief of failing to supervise or discipline any of the officers involved in the fight Sept. 17, 2005 — exactly two years before the lawsuit was filed.
According to the suit, Martinez was performing with his band at Sherrie’s Bar, 955 E. Yosemite Ave., now The Rusty Hook, when a fight broke out between a fan and a security guard. Martinez climbed down from the stage to break up the fight and was pulled outside by a Manteca police officer.
The lawsuit then claims that officer Charles Muller knocked Martinez to the ground, and while he lie there, officer Gregg Beall kicked him and shocked him several times with a Taser.
